Acceptance of Credit Cards

Creative Services accepts the following credit cards: Visa, MasterCard, American Express and Discover. There is no surcharge for using your credit card to make purchases. Please be sure to provide your exact billing address and telephone number (i.e. the address and phone number your credit card bank has on file for you). Incorrect information will cause a delay in processing your order. Your credit card will be billed upon submission of your order.

Annual PCI Compliance for Acceptance of Credit Cards

Hats Off Creative Services is committed to protecting consumer credit card data in compliance with the Payment Card Industry Data Security Standard (PCI DSS). Our alignment with this standard is reflected in the people, technologies and processes we employ.

We maintain PCI Compliance and pass rigorous testing annually to ensure our security standards are up to date for accepting credit and debit cards. We conduct regular vulnerability scans and penetration tests in accordance with the PCI DSS requirements for our business model. We attest to our PCI compliance annually, and our most recent self-attestation was completed on July 9, 2021, and expires July 9, 2022.

Electronic eBlasts/eNewsletters. If User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. If at any time the User would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email, User may contact us via our Site or they can turn off the appropriate notifications setting within their user panel. We may use third-party service providers to help us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys. We may share your information with these third parties for those limited purposes provided that you have given us your permission.

Security & Encryption

Ways to Control your Data

Opting out of marketing communications. You may receive certain promotional or informational communications from us. Accessing, updating or deleting your personal information. We value the accuracy of the information we have about you. You may access, update or delete your information (or in some cases object to its processing) at any time by submitting a Privacy Request Update.

California Online Privacy Protection Act (CalOPPA)

The CalOPPA requires that online services and commercial websites that collect personally identifiable information post a privacy policy. Those in breach of their requirements are at risk of civil litigation under California’s Unfair Competition Law.

In compliance with the CalOPPA, we agree to the following:

Anonymous user visits if wanted.
A link to the site's privacy policy will be on the site’s home page, or on the first significant page after entering the site.
The Privacy Policy link includes the word ‘Privacy’ and is easily located on the specified page.
Notification of privacy policy changes will be placed on our Privacy Policy Page.
Users will be able to change personal information by logging in to their account.

GDPR: Your Rights with Respect to Your Information

The General Data Protection Regulation (“GDPR”) in Europe gives people under its protection certain rights with respect to their personal information collected by Hats Off Creative Services. Accordingly, Hats Off recognizes and will comply with GDPR and those rights, except as limited by applicable law. The rights under GDPR include:

Right of Access. This includes your right to access the personal information we gather about you, and your right to obtain information about the sharing, storage, security and processing of that information.
Right to Correction. This is your right to request correction of your personal information.
Right to Erasure. This is your right to request, subject to certain limitations under applicable law, that your personal information be erased from our possession (also known as the “Right to be forgotten”). However, if applicable law requires us to comply with your request to delete your information, fulfillment of your request may prevent you from using some or all of our services and may result in closing your account.

Refunds & Cancellations

Projects ordered with Creative Services are offered with full client satisfaction. We pledge to complete every project per the specifications ordered -- and will work diligently to ensure a maximum client experience. We make every effort to start a project from the day the order arrives. We do not give refunds after 45 days of order placement on projects that were never started either by the customer, the dealer or the dealer's customer, but will fully honor the cancellation and credit your account for the amount paid. While unusual, some projects may run over in timelines due to coding complexity or unforeseen circumstances such as browser issues, refunds will not be given due to extended timelines.

Projects being worked on either in design, copy or web development, (not on hold or paused more than 45 days) may be cancelled by contacting Creative Services. Refunds or credit on account will be honored on remaining scope of work not completed.

Stalled Projects ON-HOLD

Creative Services makes every effort to complete a project on time every time. Because we depend on the Center and their client to keep it on track for completion, the project will be considered to be Stalled after 120 days if there is no response from the Center or their client. At that time, the project will be placed on hold in archives. To reinstate the project after 120 days with no activity, there will be a restart fee of $150. This fee is for the time required to reassign the creative team and to recover and review files . We cannot guarantee that the same team will complete the project that started it prior to the stall.

Taxes

When applicable, Creative Services shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within the same state. For orders shipped to other states, you are solely responsible for all sales taxes or other taxes.

Typographical Errors

In the event a product listed in the Marketing Dashboard website is listed at an incorrect price due to typographical error, description error or pricing error, Creative Services has the right to refuse or cancel any orders placed for erroneous product. We may refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Creative Services will immediately issue a credit to your credit card.

Warranty Work for Interactive Projects

Creative Services strives to code all interactive tools, software and websites with the highest of web standards. Upon acceptance by the customer, we guarantee and warranty for a period of 90 days that the work will be free of coding errors and defects in workmanship and will conform to the specifications in the original scope of work agreed upon and purchased. If programming errors or other defects occur within this warranty period, we will promptly remedy.

This warranty does not cover:

Problems resulting from customer actions such as adding new interactive features, plug-ins or mistakes made in the content management system.
Problems resulting from malware injections or entry by hackers.
Problems resulting from out-of-date software on the website.

While we will assist with these problems, they are not covered as part of the warranty and a fee will be charged for repairs/maintenance.

Other Conditions

These Conditions will supersede any terms and/or conditions you include with your order to Creative Services. We reserve the right to make changes to this site and these Conditions at any time.

Creative Services will occasionally update this Statement of Policies, Terms and Conditions to reflect company change and customer feedback. Creative Services encourages you to periodically review this Statement to stay informed.
